Mortimer Pleads Guilty to Killing Family

Thomas Mortimer IV pleaded guilty to four counts of first-degree murder of his wife, mother-in-law and two children.

Thomas Mortimer IV pleaded guilty to four counts of first-degree murder today. During a hearing this afternoon, Mortimer, 43, entered his plea in Middlesex Superior Court for the killing of his mother-in-law, Ragna Ellen Stone, 64; wife, Laura Stone Mortimer, 41; and children, Charlotte Mortimer, 2, and Thomas “Finn” Mortimer V, 4. Mortimer stood before the judge to explain he understands his mental health evaluations and guilty plea prevent him from having a defense based on “diminished capacity," according to WBZ. By entering the plea, Mortimer gave up his right to any appeals he could have had if he had gone to trial, according to Boston.com. Accused Murderer in Court Today

A hearing is slated for this afternoon for Thomas Mortimer IV of Winchester.

Thomas Mortimer IV has a pre-trial hearing at 2 p.m. at the Middlesex Superior Court in Woburn. District attorney’s spokeswoman Stephanie Chelf Guyotte could not offer any other details for the hearing. Mortimer, 43, was indicted by a Middlesex Grand Jury in August of 2010. He is charged with first degree murder for killing his mother-in-law, Ragna Ellen Stone, 64; wife, Laura Stone Mortimer, 41; and two children, Charlotte Mortimer, 2, and Thomas “Finn’’ Mortimer V, 4, with a butcher knife at his Windsong home in June 2010. The trial is set to begin Tuesday, Oct. 9 after a one-week postponement and is expected to last approximately three weeks. Court Rejects Winchester Murder Suspect's Claim

In a series of rulings today, the Supreme Judicial Court ruled criminal defendants in Massachusetts must prove that they can’t afford their own attorney.

The Supreme Judicial Court rejected Thomas Mortimer IV’s claim that his retirement account cannot be used to help pay for his defense today. Mortimer’s lawyer said the money in an IRA account cannot be considered liquid assets, but the court felt differently, according to Boston.com. Retirement account funds can be considered when calculating whether a defendant is indigent, and the court said that money could be used to contribute to Mortimer’s defense. ‘‘Defendants with substantial savings in IRAs, accessible after forfeiting an early withdrawal penalty, can reasonably be considered to have funds available for their defense and should be made to exhaust those accounts before the Commonwealth expends its limited resources on their …

Prosecution Seeks Mental Health Records of Accused Winchester Murderer; Trial Date Set

The trial is set to begin on Oct. 2, 2012.

The prosecution is attempting to have its psychiatrist look at the medical files of the Winchester father accused of killing his family. Thomas Mortimer, IV, is charged with four counts of first-degree murder of his mother-in-law, Ellen Ragna Stone, 64; his wife, Laura Stone Mortimer, 41; his daughter, Charlotte Mortimer, 2; and his son, Thomas “Finn” Mortimer V, 4. The trial is set to begin on Oct. 2, 2012. In July of 2010, shortly after his arrest, Mortimer was sent to Bridgewater State University where he under went a psychiatric evaluation. On Thursday afternoon, Thomas Mortimer, IV, will be back at the Middlesex Superior Court to hear a decision on an evidentiary hearing. Mortimer is charged with four counts of first-degree murder of his mother-in-law, Ellen Ragna Stone, 64; his wife, Laura Stone Mortimer, 41; his daughter, Charlotte Mortimer, 2; and his son, Thomas “Finn” Mortimer V, 4. Week in Review: A Fire, Courtroom Cleared and Businesses Struggling

Local landscapers, who rely on plowing to help them get through the winter months, have been struggling this year as Winchester has barely received 11 inches of snow. Thomas Mortimer’s attorney, Denise Regan, requested the courtroom be cleared and the information in Friday’s motion hearing be impounded. The Winchester Fire Department responded to an Arlington Street home to extinguish a fire. A faulty gas heater, according to Fire Chief John Nash, started the blaze. Lynch parents made their decision on school choice. According to Superintendent William McAlduff, 13 students will be leaving Lynch and heading to different schools in the district. Thomas Mortimer IV, who was due back at Middlesex Superior Court on Friday for a decision on an evidentiary hearing, had his court date postponed. On Monday morning, Thomas Mortimer, IV, was back at the Middlesex Superior Court for closing arguments of an evidentiary hearing.
